1. INTRODUCTION

Welcome to EduTrack ("we," "our," or "us"). EduTrack is a school management system operated by EduTrack Zambia, a registered business in Zambia (PACRA BN 320251036452, ZICTA SET/RDL/3964).

By accessing or using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

2. DEFINITIONS

  • "Service" refers to the EduTrack school management system
  • "User" means any individual accessing the system (administrator, teacher, parent, or student)
  • "School" means the educational institution registered to use the Service
  • "Data" refers to all information entered into the system

3. REGISTRATION & ACCOUNTS

To use EduTrack, schools must:

  • Provide accurate and complete registration information
  • Maintain the security of their account credentials
  • Notify us immediately of any unauthorized access
  • Ensure all users comply with these terms

We reserve the right to suspend or terminate accounts that violate these terms.

4. DATA OWNERSHIP & PRIVACY

School Data Ownership: Schools retain ownership of all data they enter into the system. We do not claim ownership of your student records, grades, or other educational data.

Data Sharing with Government: Schools may opt to share aggregated academic data with DEBS, Provincial, and Ministry dashboards. This is optional and controlled via school settings.

Data Protection: We implement industry-standard security measures to protect your data. For more details, please refer to our Privacy Policy.

5. PAYMENT & SUBSCRIPTIONS

  • Subscription fees are charged per term as displayed on our pricing page
  • SMS credits are sold separately and do not expire
  • All payments are processed in Zambian Kwacha (ZMW)
  • Refunds are provided at our discretion on a case-by-case basis
  • We reserve the right to modify pricing with 30 days notice

6. ACCEPTABLE USE

Users agree NOT to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to the system
  • Upload viruses, malware, or other harmful code
  • Harass, abuse, or harm another person through the platform
  • Interfere with or disrupt the service or servers

7. SERVICE AVAILABILITY

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access. The service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

We will provide advance notice of scheduled maintenance when possible.

8. LIMITATION OF LIABILITY

EduTrack shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions due to factors beyond our control
  • Actions taken by schools or users of the system

9. TERMINATION

Schools may terminate their subscription at any time. Upon termination:

  • Access to the service will be suspended
  • Data will be retained for 30 days then permanently deleted
  • Schools may request data export before termination
  • No refunds for prepaid unused periods

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Zambia.
